1. Victoria programme
1.1. Victoria is TAP's Customer Loyalty programme. Its Members can accrue Victoria Miles, which can be used on a vast range of awards and benefits.
1.2. Any alterations now introduced in terms of TAP and Victoria brand levels, does not affect in any way the contracts made with any single or collective entities.
2. Victoria regulations
2.1. These General Terms and Conditions define the basic rules for participation in the Victoria programme and are subject to changes. The most updated version of the General Terms and Conditions is this article.
These General Terms and Conditions have one version in Portuguese language and English and French language versions. The Portuguese one is the binding version for every effect, namely in what regards their interpretation.
2.2. TAP is authorised to change or alter General Terms and Conditions at any time without providing advance notice. Any amendments or additions to the General Terms and Conditions of the Victoria programme shall become binding for all Members, including Victoria Silver Winner and Victoria Gold Winner, as soon as they are made available on the Internet.
3. Victoria Member
3.1. By becoming a Victoria Member, Members enter into a contractual relationship with TAP governed by these General Terms and Conditions which define the rights and obligations connected to the membership to the Victoria programme.
TAP reserves the right to wholly or partially change or to terminate the Victoria programme and/or any collaboration with any partners under the Victoria programme at any time, without advance notice.
3.2 Obtaining Victoria membership
3.2.1. Victoria membership may be obtained on submission of an application (by applying on paper or electronically at this webiste), subject to subsequent approval to the programme by TAP.
3.2.2. Victoria membership is open to all natural persons of at least two years of age who are domiciled in a country that does not ban Victoria membership by law and in which the Victoria programme is available. Membership is not open to legal entities or other groups or associations. Multiple membership is not permitted.
3.2.3. Members only have the right to use the Victoria Programme benefits, after their data have been included in the Victoria database.
3.3 Terminating Victoria membership
3.3.1. Membership shall automatically cease in the event of termination of the Victoria programme.
3.3.2. TAP may terminate Victoria membership with immediate effect if the Member concerned:
- does not abide by these General Terms and Conditions and/or other rules and regulations it incorporates by reference and which have been duly and timely notified to the Member;
- attempts to obtain awards or benefits from the Victoria programme by providing false information or in any other improper or abusive way. Such Member shall be liable for any resulting damages and the Member's Victoria Miles falsely obtained will be declared null and void;
- behaves unruly on board an aircraft or on any property of any partner of an airline in the Victoria programme;
- collects no Victoria Miles in three successive years and without written notice to the Member.
3.3.3. TAP offers the Victoria programme as a benefit for its loyal customers. If Members of the Victoria programme do not accept certain rules of the Victoria programme and/or certain awards or benefits offered by same programme, or simply wish to quit the Victoria programme they are free to terminate their membership at any time, without notice period, via letter, fax or e-mail.
3.3.4. Upon termination of membership, any miles accrued up to such date and not redeemed according with these General Terms and Conditions shall be declared null and void.
3.4 Victoria membership number and membership card
3.4.1. Access to the awards and benefits of the Victoria programme is only granted in conjunction with the membership card and/or membership number.
3.4.2. Members shall receive a permanent Victoria membership card after their first flight credit with TAP or a partner airline, or after they have collected miles with one of the non-airline partners. The Victoria membership card is personal and not transferable and may not be used after its expiry date and/or after termination of membership in Victoria.
4. Victoria Miles
4.1. Victoria Miles are the unit of currency in the Victoria programme. Bonus points or miles from other programmes cannot be converted into Victoria Miles unless TAP has entered into a written agreement with such programmes.
4.2 Mileage account and e-news
Each Member shall have his/her own personal Victoria mileage account to which the miles they collect/spend will be credited/debited. Members will receive regular e-Newsletters (e-news) giving their current mileage balance, date of expiration of miles and a selection of the latest promotions and information published on the Victoria website. e-Newsletters are mailed to Members having provided a valid e-mail address and having collected or spent miles within the previous months.
Members can unsubscribe from the e-Newsletters and/ or further e-mails sent out by Victoria or its partners at any time by changing their profile via the Internet. A Member's current mileage account can be viewed on the Internet too. Access to the personal profile and mileage account is only granted via secret PIN code.
4.3 Credit of miles
4.3.1. From commencement of membership, each flight with TAP or a Victoria partner airline or the use of a service provided by selected Victoria programme partners, entitles Members to Victoria Miles, subject to these General Terms and Conditions.
4.3.2. TAP decides the type and number of miles to be credited for each programme partner and for each service provided. Type and number of miles to be credited are subject to change without advance notice.
4.3.3. The miles to be credited to the Member's personal Victoria account are calculated as follows:
- For flights on TAP worldwide and selected flights of the Victoria partner airlines:
Members will be credited the number of miles corresponding to the distance between the airports of departure and arrival of the flight. All such distances shall be based on the points of origin and destination stated on the passenger's ticket and the standards of IATA.
Flat miles will be awarded, irrespective of actual distance, for defined domestic and international short haul flights. Victoria Miles are awarded for First, Business and Economy Class travel. Members flying in Business or First Class receive a mileage bonus for their class of travel. Miles will be credited based on the fare originally paid and the class of travel booked and confirmed. Members travelling with a discounted Economy Class ticket receive fewer miles.
- For use of the services provided by selected Victoria programmepartners:
Members will be credited a fixed number of miles as published by TAP.
4.3.4. Offering promotions to a defined target group only is admissible under Victoria rules. Members excluded from such offers are not entitled to claim the same benefits and Victoria is not obliged to communicate the selection criteria for the definition of any target group.
4.3.5. The Victoria programme reserves the right to make special offers which are available only to Members who submit the appropriate registration by the deadline specified and before the flight or other service concerned is commenced. All such registrations shall be effected solely by electronic means.
The Victoria programme shall provide the corresponding registration facilities. Members registering after the deadline specified or after the commencement of the flight or other service concerned, Members who do not register at all and Members without access to electronic communication channels shall have no entitlement to the benefits offered through such electronic registration.
4.3.6. Promotions may be exclusively communicated via e-mail and/or Internet or SMS.
4.3.7. TAP and the Victoria partner airlines reserve the right to fully or partly exclude certain fares, payment and/or passenger categories as well as certain flights or categories of flights from the Victoria programme at any time.
No miles can be earned on the ticket categories ID, AD, BP, DG, DM, GE, IN, RG or UD as defined by the IATA standards. Miles for the use of the services provided by selected Victoria programme partners are only credited under the terms of booking, payment and usage of the services set out by the Victoria programme partners. No miles are credited for award or benefit travel or other award or benefit services. For upgrades against miles, miles are only credited for the fare originally booked.
Unused or expired tickets or tickets returned for monetary compensation, as well as Free Tickets, Child's Free Tickets, upgrades, Industry Discount Tickets or additionally booked seats for the same Victoria Members, do not entitle the Member to receive Victoria Miles.
The same regulation applies if a Victoria Member obtains benefits from another loyalty bonus programme for the service that is being offered.
4.3.8. Miles will normally be credited to Members' personal Victoria accounts within eight weeks of the flight/service on which they are earned if, for any reason, they were not automatically credited. The value date of such miles shall be the date of the start of the air journey or service concerned.
To ensure that the correct amount of Victoria Miles is credited to the mileage accounts, Victoria Members have to provide their membership number at reservation time or upon check-in.
It is important that the name on the booking is the same as the name the customer has on his or her Victoria membership profile in order that the miles are automatically credited.
4.3.8.1 If, for any reason, miles are not credited for a flight taken or a service used, Members may request that the amount be retroactively credited to their personal Victoria accounts for up to six months following the flight or the use of the service concerned, by submitting a written request or through the Victoria website(see Claim missing miles) together with adequate evidence material (original/copy of boarding pass, and/or copy of passenger receipt).
New Members may request retroactive claim of miles for flights taken or a service used no more than 1 month before the Victoria enrolment date.
4.3.9. TAP may not be held liable for any consequences of miles not being credited to the Member's personal account.
4.4. Validity and transfer of credited miles
4.4.1. Victoria Miles are valid for three years from the date of accrual unless specified otherwise. The validity of the miles is calculated as from the date of accrual.
4.4.2. Before expiry, miles' validity can be extended against a fee and with credit card payment only. Extended miles are considered as Bonus Miles and are valid for another three years.
4.4.3. Victoria mileage accounts are non-transferable. Victoria Miles may be transferred against a fee and with credit card payment only. Victoria Miles may not be redeemed for cash.
4.4.4. A fixed number of Bonus Miles may be purchased with credit card only and against a fee (see "Buy Miles"). Purchase frequency and the amount of miles that can be accrued are limited.
5. Awards and benefits
5.1. Booking or ordering awards or benefits
5.1.1. Current offers of awards and benefits are available on the Internet, in respective mailings or through the Service Centre. TAP reserves the right to change, supplement or annul the individual awards and benefits. The Victoria partner airlines and the Victoria programme partners may set out advance terms for booking or ordering of awards and benefits. Such advance terms may vary for each benefit or award.
5.1.2. When booking or ordering an award or benefit with/from a Victoria partner airline or a Victoria programme partner, the Member enters into a contractual relationship with the individual provider of such award or benefit. Such award or benefit is subject to the relevant booking arrangements and the terms and conditions by and between the individual provider of an award or benefit and the Member.
When booking or ordering such award or benefit, the Member does not enter into a contractual relationship with TAP and this latter does not assume any liability for the due performance or the fitness for any purpose of any services rendered for the quality of goods delivered as awards and/or benefits.
5.1.3. TAP accepts no liability for any taxes or other charges or disadvantages to which Victoria Members may be subject in connection with the redemption of Victoria Miles or Victoria awards and benefits. All taxes (airport, fuel, security or others) as well as any credit card fees will be supported by the Victoria Member.
5.1.4. When booking or ordering an award or benefit, Members must state in advance that they are booking an award or benefit. Ordinary bookings or orders may not be changed into bookings or orders of awards or benefits.
TAP and the Victoria partner airlines or the Victoria programme partners may refuse to grant an award or benefit if the Member has already made a reservation for a flight or service without clearly stating that such reservation is of a Victoria award or benefit nature. Any award documents obtained illegally or in contravention of these General Terms and Conditions will not be honoured.
5.1.5. Seat availability for award tickets varies according to destination and time. The number of seats is limited even on flights which are not yet fully booked. All personal and travel documentation validity is the responsability of the Victoria frequent flyer programme member (ID, Passport, Visa or others).
Restrictions may apply during certain times and for any award types.
5.1.6. Issued flight awards expire within one year after issuance, except awards issued under any promotion, in which case they are only valid during the promotional period, while other benefits stay valid according to booking arrangements and/or as specified by the relevant Victoria programme partner.
5.1.7. The awards and benefits issued under the terms and conditions of a promotion are only valid for the duration of that same promotion. Issued awards and benefits cannot be transferred, replaced, extended, otherwise changed or refunded, except if and to the extent explicitly stated to the contrary in the individual booking arrangement or terms and conditions of TAP, the Victoria partner airline or the Victoria programme partner as the case may be.
In case an award or benefit may be replaced, extended or otherwise changed, such replacement, extension or change may be subject to a handling fee to be borne by the Member. A separate fee applies for the handling of award tickets after no-show at departure.
5.1.8. Awards and benefits may only be assigned to persons who would be acceptable for membership to the Victoria programme or are already a Member of the Victoria programme. Once issued, awards and benefits may no longer be assigned.
TAP reserves the right to ask for a written authorisation in case a Member requests of an award or benefit for a third person.
6. Processing of personal Member data
6.1. Members expressly authorise TAP, the administrator and the partners of the Victoria programme selected by TAP as well as the Member's travel agencies and servicing companies of the Victoria programme to use any Personal Data provided by the Members (which includes data considered highly sensitive, such as data revealing race or religion e.g. in relation to special meal requests) in connection namely with the operation of the Victoria programme, with flights on programme airlines and/or for further marketing activities.
6.2. The Personal Data will be treated as confidential and will only be passed on to Victoria partner companies, to the Members' travel agency and to servicing and partner companies of the Victoria programme.
Such recipients of personal data may be located in countries outside the country of residence of a Member and Members expressly consent to such worldwide data-processing. All Members have access to their Personal Data, and can request correction of false data.
7. Internet services
7.1. Members may access their personal Victoria account through the Internet. TAP may make further services available to the Members, through the Internet within the framework of the Victoria programme.
7.2. TAP reserves the right to change any of the content described on its websites at any time without notice.
7.3. For identification purposes of the Member in order to be granted Internet access to the personal Victoria account and to other Internet services of the Victoria programme to the Members, TAP, its partners and suppliers may solely rely on the transmission of the membership number and the Personal Identification Number (PIN), which can be defined on the website or can be obtained by calling a Service Centre.
7.4. By accessing the Victoria website the Members undertake not to use any robot, spider, other automatic device, or manual process to monitor or copy any web page or the content contained therein without our prior expressed written permission.
The Members further undertake not to use any device, software or routine to interfere or attempt to interfere with the proper working of website. The Members further undertake not to take any action that imposes an unreasonable or disproportionately large load on the Victoria's Internet infrastructure.
7.5. The information, software, products and services included in or available through the Victoria website may include inaccuracies or typographical errors.
In no event shall TAP, its affiliates, servicing agencies and partners or respective employees be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or the performance of the Victoria website, with the delay or the inability to use the website or related services, or otherwise arising out of the use of such website.
7.6. The Victoria website contains information which has been prepared solely to provide information about TAP, its customer loyalty programme, Victoria and its partners. It does not constitute an offer to sell any securities and must not be relied upon in connection with any investment decision.
8. Miscellaneous
8.1. Members are solely responsible for fully informing any third parties, companies (such as their employer) or governmental body about their membership to the Victoria programme and about the awards and benefits available to them under the Victoria programme.
Victoria grants miles to their Members only and is not responsible for any agreements between Members and any third parties (such as employers).
8.2. In some countries, local law may impose restrictions on the Members and/or the General Terms and Conditions of the Victoria programme.
TAP, the administrator and the partners of the Victoria programme, as well as respective suppliers are entitled to take any action required to ensure compliance with such restrictions and may not be held liable for damages suffered by Members as a result of such actions.
8.3. TAP reserves the right to entrust the operation of the Victoria programme to successor companies or to a third party, and to transfer agreements with the Victoria programme's Members to such successor companies or to a third party to that end. The programme is subject to changes based on any alliance strategies of TAP.
8.4. TAP reserves the right to introduce fees for services related with the operation of the Victoria programme, such as providing specific programme information, handling of award bookings.
8.5. The Victoria programme is subject to Portuguese law. The exclusive place of jurisdiction is Lisbon courts of law, Portugal.
8.6. To use the telephone line, Members consent to the possibility of telephone calls being recorded for control, improved services and/or training purposes.
